• Overview

These Terms & Conditions, together with any policies or additional terms referenced herein, form an agreement between you and BTA Sports (“BTA Sports,” “we,” “us,” or “our”) regarding your access to and use of our website, mobile application, subscriptions, tools, projections, data, media, content, communications, and related services collectively, the “Services.”

By accessing or using the Services, creating an account, starting a trial, purchasing a subscription, or otherwise interacting with BTA Sports, you agree to these Terms & Conditions. If you do not agree, you should not access or use the Services.

1 General Information and Services

BTA Sports provides news, media, analysis, projections, sports-related insights, betting education, prediction tools, data-driven content, and related entertainment services. Our Services may include football, baseball, fantasy sports, DFS, player props, projections, betting-related educational content, and other sports analytics features.

All content reflects the opinions, models, data interpretations, analysis, or insights of BTA Sports, its team, contributors, vendors, or third-party data sources. While we strive for accuracy and quality, BTA Sports does not guarantee that any content, projection, prediction, statistic, model output, recommendation, article, video, tool, or data point is accurate, complete, timely, reliable, uninterrupted, or error-free.

You are solely responsible for independently evaluating all information and making your own decisions. Any use of the Services is at your own risk.

2 Eligibility and Age Requirements

You may use the Services only if you are legally permitted to do so in your jurisdiction and can form a binding agreement with BTA Sports.

The BTA Sports app and Services are intended for users who are at least 17 years old. Certain content may reference sports betting, fantasy sports, DFS, odds, wagering concepts, or gambling-related topics. You must be of legal age in your jurisdiction to participate in any gambling, betting, sportsbook, DFS, fantasy contest, or related activity outside of BTA Sports.

BTA Sports does not knowingly collect personal information from children under 13. If you are under the age required to use the Services or are prohibited from using sports betting-related informational services in your location, you may not use the Services.

3 No Financial, Investment, Betting, or Gambling Advice

BTA Sports is not a financial advisor, investment advisor, gambling advisor, sportsbook, broker, bookmaker, casino, gaming operator, or fiduciary. The Services should not be interpreted as financial, investment, legal, tax, betting, gambling, or professional advice.

All strategies, predictions, projections, model outputs, confidence scores, rankings, betting-related commentary, fantasy or DFS analysis, articles, videos, posts, or recommendations are provided for informational and entertainment purposes only.

We do not guarantee any particular outcome, including a win, profit, return, fantasy result, DFS result, betting result, subscription result, or financial gain. You assume full responsibility for any decisions or actions taken based on the Services.

4 Compliance with Local Laws

You are solely responsible for ensuring that your access to and use of the Services complies with all laws, rules, and regulations applicable in your jurisdiction.

Laws relating to sports betting, fantasy sports, DFS, gambling, promotions, contests, and related activities vary by country, state, province, and locality. BTA Sports does not represent that the Services are appropriate, legal, or available in every location.

BTA Sports does not endorse, promote, or facilitate illegal gambling activities. If using the Services or acting on sports-related information is unlawful in your location, you may not use the Services for that purpose.

5 Paid Subscription Details

Certain BTA Sports features, tools, content, projections, and services may require a paid subscription. Subscription availability, pricing, trial offers, billing periods, features, and promotional offers may vary by platform, season, location, and time.

Automatic Renewal

Subscriptions automatically renew unless canceled before the end of the then-current billing period or trial period. If you do not cancel before the trial or billing period ends, you may be charged for the next period.

Cancellation

If you purchased through Apple, you can manage or cancel your subscription through your Apple ID subscription settings. BTA Sports cannot directly cancel an Apple-managed subscription on your behalf.

To manage an Apple subscription, go to your device settings, tap your Apple ID, select Subscriptions, and choose the BTA Sports subscription.

Refunds

Payments, refunds, cancellations, and billing disputes for subscriptions purchased through the Apple App Store or another app store are generally handled by the applicable app store or payment provider and are subject to that provider’s terms and policies. BTA Sports does not control app store refund decisions.

Pricing and Feature Changes

We may change subscription pricing, features, plans, trial availability, promotional offers, or access levels from time to time, subject to applicable law and app store requirements. Any changes will apply as permitted by the platform through which you purchased your subscription.

6 Accounts and Account Security

You may be required to create an account or sign in to access certain Services. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify BTA Sports promptly if you suspect unauthorized access to or use of your account.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms & Conditions, misuse the Services, interfere with the platform, engage in fraud or abuse, or create legal, operational, or security risk for BTA Sports or other users.

7 App License and App Store Terms

If you download, access, or use the BTA Sports mobile app, BTA Sports grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app solely for your personal, lawful, non-commercial use and in accordance with these Terms & Conditions and any applicable app store rules.

The app is licensed, not sold, to you. BTA Sports and its licensors reserve all rights in and to the app, Services, content, design, code, data, models, trademarks, and technology not expressly granted to you.

Apple App Store Terms

If you access or download the BTA Sports app through the Apple App Store, you acknowledge and agree that:

• These Terms & Conditions are between you and BTA Sports, not Apple.
• BTA Sports is solely responsible for the app and its content, subject to applicable law.
• Your use of the app must comply with Apple’s applicable App Store terms and usage rules.
• Apple has no obligation to provide maintenance or support services for the app.
• Apple and its subsidiaries are third-party beneficiaries of the app-related terms and may enforce them against you as a third-party beneficiary.

To the extent Apple’s Standard Licensed Application End User License Agreement applies to your download or use of the BTA Sports app, those terms also apply unless superseded by a valid custom license agreement.

License Restrictions

You may not:

• Copy, modify, distribute, sell, lease, rent, sublicense, transfer, or create derivative works from the app or Services.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the app or Services, except where such restriction is prohibited by applicable law.
• Use the Services to develop competing products, models, data products, projections, or analytics services.
• Use automated scraping, bots, crawlers, scripts, or other automated tools to access or extract content or data without written permission.
• Remove, obscure, or alter any copyright, trademark, attribution, or proprietary notices.

8 Use of Content and Intellectual Property

All content on or through the Services, including but not limited to text, graphics, logos, designs, videos, audio, images, software, data, statistics, models, formulas, projections, tools, confidence scores, articles, rankings, graphics, and other materials, is owned by BTA Sports or its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws.

The Services are intended for your personal, non-commercial use only. You may not reproduce, distribute, republish, sell, resell, license, publicly display, publicly perform, modify, scrape, download in bulk, or otherwise exploit any materials from BTA Sports without our prior written consent.

“BTA Sports,” related logos, product names, feature names, graphics, and branding are trademarks, service marks, or trade dress of BTA Sports. You may not use them without written permission.

9 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms & Conditions.

You agree not to:

• Use the Services in violation of any applicable law, regulation, or third-party right.
• Use the Services to facilitate illegal gambling or unlawful betting activity.
• Misrepresent your identity, age, location, or eligibility to use the Services.
• Share, resell, sublicense, distribute, or commercially exploit your account access or subscription.
• Attempt to bypass paywalls, subscription controls, security systems, or access restrictions.
• Interfere with, disrupt, or overload the Services or related infrastructure.
• Upload, transmit, or introduce malware, harmful code, or security vulnerabilities.
• Use the Services to harass, abuse, defame, threaten, or harm another person.
• Copy, scrape, harvest, or extract BTA Sports data, projections, or content without written authorization.
• Use the Services to train, develop, benchmark, or improve competing commercial analytics, betting, AI, machine learning, or sports prediction systems without written permission.

10 Third-Party Links, Data, Platforms, and Services

The Services may contain links to third-party websites, sportsbooks, advertisers, media platforms, app stores, payment processors, analytics providers, social media platforms, content providers, data providers, or other third-party services.

We do not control and are not responsible for the content, availability, accuracy, privacy practices, terms, or conduct of third parties. Your interactions with third parties are solely between you and the applicable third party.

BTA Sports is not liable for any damages, losses, claims, charges, fees, disputes, betting losses, account issues, privacy issues, or other consequences arising from your interaction with third-party platforms, sportsbooks, payment providers, websites, advertisers, or services.

11 Privacy Policy and User Data Protection

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, protect, retain, and share information. Please review our Privacy Policy carefully.

b. Data Collection

We collect information necessary to operate, maintain, secure, support, measure, and improve the Services. This may include account information, contact information, user IDs, device identifiers, product interaction data, app usage data, subscription status, purchase history, trial events, and related analytics or attribution information.

c. Data Usage

Information may be used for app functionality, account management, subscription management, customer support, analytics, product improvement, fraud prevention, security, performance measurement, marketing measurement, and attribution.

d. Analytics, Attribution, and Tracking

We may use third-party analytics and attribution tools, including AppsFlyer, Mixpanel, app stores, payment providers, and other service providers, to analyze usage patterns, measure app performance, understand how users discover BTA Sports, evaluate marketing campaigns, measure subscription conversion events, and improve the Services.

Depending on your device settings, consent choices, and our provider configurations, certain data such as device identifiers, product interaction data, and purchase or subscription conversion data may be used for tracking or attribution as described in our Privacy Policy.

e. Data Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect user data from unauthorized access, disclosure, misuse, alteration, or loss. No system can be guaranteed to be completely secure.

f. Data Retention and Deletion

User data is retained for as long as reasonably necessary to provide the Services, manage accounts and subscriptions, provide support, analyze and improve the Services, measure attribution and marketing performance, prevent fraud, comply with legal obligations, resolve disputes, and enforce agreements.

You may request deletion of your account or personal information as described in our Privacy Policy. Some information may be retained where required or permitted by law, for security, fraud prevention, accounting, legal compliance, dispute resolution, or backup purposes.

12 Disclaimer of Warranties

The Services and all content, data, projections, tools, models, software, subscriptions, and materials are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by law, BTA Sports disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted or error-free operation.

We do not warrant that the Services will be secure, uninterrupted, timely, accurate, complete, free of errors, free of harmful components, or that any defects will be corrected. We do not warrant or guarantee any sports result, betting outcome, fantasy result, DFS outcome, player performance, projection accuracy, model output, subscription result, or financial result.

13 Limitation of Liability

To the fullest extent permitted by law, BTA Sports and its owners, officers, directors, employees, contractors, partners, affiliates, licensors, vendors, service providers, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, subscription losses, betting losses, gambling losses, fantasy losses, DFS losses, or other financial losses arising out of or related to your use of or inability to use the Services.

To the fullest extent permitted by law, BTA Sports’ total liability for any claim arising out of or related to the Services or these Terms & Conditions will not exceed the amount you paid to BTA Sports for the Services during the three months before the claim arose, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

14 Indemnification

You agree to defend, indemnify, and hold harmless BTA Sports and its owners, officers, directors, employees, contractors, partners, affiliates, licensors, vendors, service providers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your access to or use of the Services.
• Your violation of these Terms & Conditions.
• Your violation of any law, regulation, or third-party right.
• Your misuse of BTA Sports content, data, tools, models, or projections.
• Your betting, gambling, DFS, fantasy sports, sportsbook, or third-party platform activity.
• Your account activity, whether authorized by you or not, unless caused solely by BTA Sports’ gross negligence or willful misconduct.

15 Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Services at any time if we believe you have violated these Terms & Conditions, created risk for BTA Sports or other users, misused the Services, engaged in fraudulent or abusive behavior, violated applicable law, or interfered with the security or operation of the Services.

You may stop using the Services at any time. Canceling or deleting your account does not automatically cancel app store-managed subscriptions. If your subscription is managed by Apple or another app store, you must cancel through the applicable app store account settings.

Sections that by their nature should survive termination will survive, including provisions relating to ownership, license restrictions, disclaimers, limitation of liability, indemnification, privacy, governing law, and dispute resolution.

16 Responsible Gambling

BTA Sports promotes responsible gambling. Gambling should be treated as entertainment, not as a source of income. You should only participate in lawful gambling activities if you are legally eligible and physically located in a jurisdiction where such activity is permitted.

17 Changes to the Services

We may update, modify, suspend, discontinue, replace, remove, or limit any part of the Services at any time, including features, tools, projections, content, subscriptions, pricing, plans, data sources, sports coverage, or availability.

We are not liable for any modification, suspension, discontinuation, downtime, feature change, or unavailability of the Services, except as required by applicable law.

18 Changes to These Terms

BTA Sports reserves the right to modify these Terms & Conditions at any time. Changes will be posted on this page with an updated “Last Updated” date.

If changes are material, we may provide additional notice through the app, website, email, or other appropriate means. Your continued use of the Services after updated Terms & Conditions are posted means you accept the updated terms.

19 Governing Law and Dispute Resolution

These Terms & Conditions and any dispute arising out of or relating to the Services will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles, unless applicable consumer protection laws require otherwise.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms & Conditions or the Services will be brought in the state or federal courts located in Pennsylvania, unless applicable law requires another forum.

Before filing a claim, you agree to first contact BTA Sports at [email protected] or [email protected] and attempt to resolve the dispute informally.

20 Miscellaneous

If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms & Conditions does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms & Conditions or your rights under them without our prior written consent. We may assign these Terms & Conditions in connection with a merger, acquisition, financing, reorganization, sale of assets, or other business transaction.

These Terms & Conditions, together with the Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and BTA Sports regarding the Services.
